Why are special needs trusts important? Special needs trusts allow persons with physical or mental disabilities or a serious illness to have unlimited assets held in trust for their benefit. If a trust is properly drafted as either a supplemental or special needs trust, the government does not count the assets in it when determining whether the beneficiary qualifies for government benefits.
